1. Scope of Application

(1) These Terms and Conditions (Terms”) apply to all orders placed via the online shop [www.thefaceface.com](https://www.thefaceface.com), operated by

theFaceFace, Inc. Tatiana Goller, Lilienthalstraße 22, 10965 Berlin, Germany**

(hereinafter referred to as theFaceFace”, we”, or us”).

(2) In addition to these Terms, our Privacy Policy applies to the collection and use of personal data. You can view it anytime at [www.thefaceface.com/privacy](https://www.thefaceface.com/privacy).

(3) For the purposes of these Terms, a consumeris any natural person who concludes a transaction for purposes that are not primarily related to their trade, business, or profession. An entrepreneur is any natural or legal person or partnership acting in the exercise of their trade or professional activity when concluding a transaction.

2.Order Process and Contract Formation

(1) The product listings in our online shop do not constitute a binding offer to conclude a contract. They are provided for informational purposes to allow you to submit a purchase offer to us.

(2) Consultation Requirement:

Most products offered are professional skincare formulations that differ in efficacy from over-the-counter cosmetics. For this reason, such products can only be purchased after an Online Skin Consultation with theFaceFace.

During the consultation, your skin profile will be analyzed, and appropriate products will be recommended. These may then be purchased in our webshop.

(3) You may add products to your shopping cart using the Buy Now” button without obligation. You can review your cart at any time, adjust quantities, or remove items. To proceed with your purchase, click Checkout.”

New customers will be asked to register; existing customers can log in to use their stored data.

(4) By clicking Register Now,” you consent to the creation of a customer account. Your usage data may be analyzed to personalize your shopping experience. More details can be found in our Privacy Policy.

(5) By clicking Buy Now,” you submit a binding offer to conclude a purchase contract for the items in your cart.

(6) The contract is formed depending on the selected payment method:

Prepayment (Bank Transfer):Upon receipt of an order confirmation email containing our bank details.

Credit Card: Upon authorization of your card by your card issuer.

PayPal:Upon confirmation of your payment instruction to PayPal.

Klarna / BillPay / Billie (Invoice or Direct Debit): Upon acceptance email or dispatch of the goods.

(7) We reserve the right to reject or cancel any order without stating a reason, especially for business customers where the order value exceeds EUR 4,000 (gross).

(8) The contract text will be stored. Order data and the Terms will be sent to you by email. You can review previous orders in your customer account.

3. Prices and Shipping Costs

(1) All prices are stated in euros, inclusive of statutory VAT, and exclusive of shipping costs. Orders over 50 (after discount deductions) qualify for free shipping within Germany.

(2) Shipping costs are shown during checkout and are borne by you unless you exercise your right of withdrawal. In case of withdrawal, we will refund shipping costs for the standard delivery method only.

(3) In the event of pricing errors on our website, theFaceFace reserves the right to withdraw from the contract immediately upon discovery.

4. Payment and Retention of Title

(1) Accepted payment methods (not all may be available at all times):

Credit Card, PayPal, Prepayment, BillPay Direct Debit, Klarna Invoice, Billie Invoice for Business Customers.

(2) The goods remain the property of theFaceFace, Inc. Tatiana Goller until full payment is received.

Before ownership is transferred, pledging, transferring as security, processing, or transformation of the goods is not permitted without our written consent.

5. Delivery and Shipping

(1) Orders are shipped by courier to the delivery address you provide. The shipping risk is borne by us if you are a consumer.

(2) Deliveries are available within Germany and, upon individual agreement, abroad (excluding Helgoland). Deliveries to Packstations are currently not available.

(3) Partial deliveries are permitted if reasonable for you. No additional shipping costs will be charged for this.

(4) You are responsible for providing accurate and complete delivery details. Additional shipping costs resulting from incorrect addresses are your responsibility.

(5) If you exercise your right of withdrawal, you are responsible for return shipping costs for items suitable for parcel delivery.

6. Right of Withdrawal for Consumers

(1) Consumers have a statutory right of withdrawal within 14 days.

This right does not apply to:

 * Goods made to the consumers specifications or clearly personalized,

* Opened skincare or cosmetic products (for hygiene reasons),

* Perishable goods or goods with expired shelf life.

You will then receive the return address and further instructions. 

Withdrawal Policy

Right of Withdrawal:

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period begins on the day you or a third party (other than the carrier) receive the goods.

To exercise your right, you must send a clear declaration of withdrawal by email to [info@thefaceface.com](mailto:info@thefaceface.com).

Consequences of Withdrawal:

We will refund all payments received from you, including standard shipping costs, within 14 days of receiving your withdrawal notice.

Refunds will be made using the same payment method used for the original transaction.

We may withhold the refund until we have received the goods back or you have provided proof of return.

You must return the goods within 14 days of notifying us of withdrawal.

If the goods are not suitable for parcel shipping, we will arrange collection via a freight service at your expense.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

 7. Voluntary 30-Day Return Policy

In addition to your statutory right of withdrawal, we offer a voluntary 30-day return policy for all products purchased via our online shop.

Simply return the original, unopened, and undamaged goods within 30 days of receipt after contacting [info@thefaceface.com](mailto:info@thefaceface.com) for instructions.

Return shipping costs under this voluntary policy are not reimbursed.

8. Warranty

(1) Legal warranty rights apply under §§ 434 et seq. BGB (German Civil Code).

Consumers may choose between repair or replacement.

For business customers, theFaceFace may decide whether to repair or replace the product.

(2) The inspection and notification obligations under § 377 HGB apply to merchants.

9. Liability

(1) Except as otherwise provided by law, theFaceFace shall not be liable for damages other than:

 * injury to life, body, or health;

* intentional or grossly negligent breaches of duty;

* breach of essential contractual obligations (cardinal duties).

 (2) In cases of simple negligence, liability is limited to the foreseeable, contract-typical damages.

(3) theFaceFace is not liable for delivery delays caused by force majeure (e.g., weather conditions, strikes, transport issues).

(4) The provisions of the Product Liability Act remain unaffected.

10. Final Provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) The contract language is German.

(3) The place of jurisdiction for business customers, legal entities under public law, or special public funds is **Berlin, Germany**.

(4) If any clause of these Terms is found invalid, the remaining provisions shall remain valid.

(5) The European Commission provides an Online Dispute Resolution (ODR) platform at [https://ec.europa.eu/consumers/odr](https://ec.europa.eu/consumers/odr).

We are not obliged and do not participate in dispute resolution before a consumer arbitration board.
